Terms and Conditions

By accessing or using MindGTC Web3 Builder, including connecting a wallet or using any of our tools — token creation, liquidity pools, token locking, airdrops, collectibles, portfolio tracking, or trading features — you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

You represent and warrant that you:

• Are at least 18 years old;
• Have the legal capacity to enter into a crypto environment;
• Are not located in, or a resident of, any jurisdiction where use of the Services is prohibited or restricted; and
• Are not subject to economic sanctions or listed on any prohibited or restricted parties list.

You are solely responsible for ensuring that your use of the Services complies with the laws and regulations applicable to you.

The Platform is non-custodial. We never take possession, custody, or control of your digital assets, private keys, or seed phrases. All transactions are initiated, signed, and authorized by you through your own wallet. You are solely responsible for safeguarding your wallet credentials — transactions on public blockchains are irreversible, and we cannot recover lost keys or reverse transactions.

The Platform provides software tools that interact with public blockchain networks (including Solana and Ethereum). This includes:

• Creating and launching tokens;
• Creating and managing liquidity pools;
• Locking and vesting tokens;
• Distributing tokens via airdrops;
• Viewing and managing NFT collectibles;
• Portfolio tracking and market analytics; and
• Access to third-party fiat on/off-ramp services (e.g., MoonPay).

We do not act as a broker, dealer, exchange, financial institution, money transmitter, or investment adviser. Market data and analytics are provided for informational purposes only.

Nothing on the Platform constitutes financial, investment, legal, tax, or other professional advice. Digital assets are highly volatile and speculative. You should conduct your own research and consult qualified professionals before making any financial decision. You may lose all funds you commit.

You acknowledge and accept the risks of blockchain technology, including:

• Extreme price volatility and potential total loss of value;
• Smart contract vulnerabilities, exploits, and protocol failures;
• Irreversibility of blockchain transactions;
• Network congestion, forks, and downtime;
• Regulatory uncertainty and changes in applicable law;
• Third-party tokens and projects on the Platform that may be fraudulent, have no value, or fail entirely.

Tokens listed or launched on the Platform are created by third parties. We do not endorse, vet, or guarantee any token or project.

Certain Services may incur platform fees, which are displayed before you confirm a transaction. In addition, blockchain network fees (gas) and third-party provider fees (e.g., MoonPay) apply and are outside our control. All fees are non-refundable once a transaction is confirmed on-chain.

When using the Platform, you agree not to:

• Violate any applicable law, including securities, anti-money laundering, and sanctions regulations;
• Create or distribute tokens that infringe intellectual property rights or are designed to defraud others;
• Engage in market manipulation, wash trading, or deceptive practices;
• Attempt to interfere with, exploit, or disrupt the Platform or its infrastructure;
• Use bots, scrapers, or automated means to access the Services in a manner that burdens our systems; or
• Impersonate any person or entity.

The Platform, including its software, design, logos, and content (excluding user-generated and blockchain content), is owned by MindGTC or its licensors and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose.

The Platform integrates third-party services (including MoonPay for fiat on/off-ramping and Streamflow for token vesting). Your use of those services is governed by their own terms and policies. We are not responsible for the acts or omissions of third parties.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MARKET DATA WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDGTC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DIGITAL ASSETS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

You agree to indemnify and hold harmless MindGTC and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Platform and its users. You may stop using the Services at any time; provisions that by their nature should survive termination will survive.

We may revise these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by applicable law without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be resolved by binding arbitration or the competent courts, as permitted by applicable law.
